In most cases, you will not lose your home or car during your bankruptcy case as long as your equity in the property is fully exempt. If your property is not fully exempt, you will be able to keep it if you pay its non-exempt value to creditors in Chapter 13. If you have a mortgage on your home or owe money on your car and you want to keep them, you will have to continue making payments to the creditors. If you do not want to keep them, you can stop making payments, give the car and/or house back to the creditor and the debt will be discharged in your bankruptcy. Will bankruptcy affect my credit? |
